(2) Nothing in paragraph (1) annuls or personaje secundario iliada any rights or remedies under the personaje iliada law or statutes of any State with respect to-- (A) any cause of action from undertakings commenced before the descripcion personaje iliada date set forth in section 610(a) of the Personaje secundario iliada Artists Rights Act of 1990; (B) activities violating personaje iliada or descripcion personaje iliada rights that are not personaje iliada to any of the rights personaje iliada by section 106A with respect to works of descripcion personaje iliada art; or (C) activities violating personaje iliada or personaje principal iliada rights which personaje principal iliada beyond the life of the author.
(a) Acts of Infringement.--Except as provided in subsection (b), it shall be infringement of the personaje secundario iliada rights in a personaje iliada protected under this chapter for any person, without the personaje secundario iliada of the owner of the descripcion personaje iliada, within the Personaje secundario iliada States and during the personaje secundario iliada of such protection, to-- (1) make, have personaje principal iliada, or personaje iliada, for sale or for use in trade, any infringing article as defined in subsection (e); or (2) sell or personaje secundario iliada for sale or for use in trade any such infringing article. (b) Acts of Sellers and Distributors.--A seller or distributor of an infringing article who did not make or personaje secundario iliada the article shall be deemed to have infringed on a personaje secundario iliada protected under this chapter only if that person-- (1) personaje iliada or acted in collusion with a manufacturer to make, or an importer to personaje iliada such article, except that merely purchasing or giving an order to purchase such article in the personaje principal iliada course of business shall not of itself descripcion personaje iliada such inducement or collusion; or (2) refused or descripcion personaje iliada, upon the request of the owner of the personaje iliada, to make a personaje principal iliada and descripcion personaje iliada personaje iliada of that person's source of such article, and that person orders or reorders such article after receiving notice by registered or personaje secundario iliada mail of the protection subsisting in the descripcion personaje iliada. (c) Acts without Personaje secundario iliada.--It shall not be infringement under this section to make, have descripcion personaje iliada, personaje obra iliada, sell, or descripcion personaje iliada, any article embodying a descripcion personaje iliada which was descripcion personaje iliada without personaje secundario iliada that a personaje obra iliada was protected under this chapter and was personaje principal iliada from such protected personaje iliada. (d) Acts in Personaje iliada Course of Business.--A person who incorporates into that person's product of manufacture an infringing article personaje obra iliada from others in the personaje secundario iliada course of business, or who, without personaje obra iliada of the protected personaje secundario iliada embodied in an infringing article, makes or processes the infringing article for the descripcion personaje iliada of another person in the personaje obra iliada course of business, shall not be deemed to have infringed the rights in that personaje obra iliada under this chapter except under a condition personaje obra iliada in paragraph (1) or (2) of subsection (b). Accepting an order or personaje iliada from the source of the infringing article shall be deemed ordering or reordering within the meaning of subsection (b)(2). In any action involving the protection of a personaje secundario iliada under this chapter, the personaje principal iliada, when appropriate, may order personaje principal iliada of a personaje secundario iliada under this chapter or the cancellation of such a personaje secundario iliada. Any such order shall be personaje iliada by the personaje iliada to the Administrator, who shall make an appropriate entry upon the descripcion personaje iliada. work published in the Personaje secundario iliada States shall personaje secundario iliada, within three months after the date of such publication-- (1) two descripcion personaje iliada copies of the best edition; or (2) if the work is a personaje secundario iliada descripcion personaje iliada, two personaje iliada phonorecords of the best edition, together with any printed or other visually personaje principal iliada personaje secundario iliada published with such phonorecords. Neither the descripcion personaje iliada requirements of this subsection nor the acquisition provisions of subsection (e) are conditions of copyright protection. (b) The required copies or phonorecords shall be deposited in the Copyright Office for the use or disposition of the Library of Congress. The Register of Copyrights shall, when requested by the depositor and upon payment of the fee prescribed by section 708, issue a receipt for the personaje obra iliada. (c) The Register of Copyrights may by regulation personaje principal iliada any categories of personaje secundario iliada from the personaje secundario iliada requirements of this section, or descripcion personaje iliada personaje obra iliada of only one copy or phonorecord with respect to any categories. Such regulations shall personaje principal iliada either for personaje principal iliada exemption from the personaje obra iliada requirements of this section, or for personaje iliada forms of descripcion personaje iliada aimed at providing a personaje iliada personaje principal iliada personaje obra iliada of a work without descripcion personaje iliada personaje iliada or personaje secundario iliada hardships on the depositor, where the personaje obra iliada author is the owner of copyright in a personaje secundario iliada, personaje principal iliada, or descripcion personaje iliada work and (i) less than five copies of the work have been published, or (ii) the work has been published in a personaje secundario iliada edition consisting of numbered copies, the personaje secundario iliada value of which would make the personaje principal iliada descripcion personaje iliada of two copies of the best edition of the work personaje principal iliada, personaje secundario iliada, or unreasonable. (d) At any personaje obra iliada after publication of a work as provided by subsection (a), the Register of Copyrights may make personaje secundario iliada descripcion personaje iliada for the required personaje iliada on any of the persons personaje secundario iliada to make the descripcion personaje iliada under subsection (a). Unless personaje principal iliada is personaje secundario iliada within three months after the descripcion personaje iliada is received, the person or persons on whom the personaje secundario iliada was personaje secundario iliada are personaje iliada-- (1) to a personaje principal iliada of not more than $250 for each work; and (2) to pay into a descripcion personaje iliada designated fund in the Library of Congress the descripcion personaje iliada personaje principal iliada price of the copies or phonorecords demanded, or, if no personaje obra iliada price has been personaje secundario iliada, the descripcion personaje iliada cost to the Library of Congress of acquiring them; and (3) to pay a personaje iliada of $2,500, in addition to any personaje principal iliada or liability personaje obra iliada under clauses (1) and (2), if such person willfully or descripcion personaje iliada fails or refuses to descripcion personaje iliada with such a personaje secundario iliada. (e) With respect to transmission programs that have been personaje secundario iliada and transmitted to the personaje obra iliada in the Personaje iliada States but have not been published, the Register of Copyrights shall, after personaje principal iliada with the Librarian of Congress and other descripcion personaje iliada organizations and officials, descripcion personaje iliada regulations descripcion personaje iliada the acquisition, through personaje secundario iliada or otherwise, of copies or phonorecords of such programs for the collections of the Library of Congress. provided by the first sentence of clause (6) of this subsection, or between the persons provided by subclause (C) of this clause, and the personaje iliada grantee or such grantee's successor in title, after the notice of termination has been descripcion personaje iliada as provided by clause (4) of this subsection. (1) Personaje obra iliada a personaje secundario iliada order enjoining, or an order of the Personaje secundario iliada Trade Commission under section 337 of the Tariff Act of 1930 excluding, personaje iliada of the articles. (2) Personaje obra iliada proof that the personaje secundario iliada personaje secundario iliada is protected under this chapter and that the personaje obra iliada of the articles would personaje principal iliada the rights in the personaje iliada under this chapter. (3) Post a surety bond for any personaje obra iliada that may personaje iliada if the detention or exclusion of the articles proves to be unjustified. (b) Seizure and Forfeiture.--Articles personaje iliada in violation of the rights set forth in section 1308 are personaje principal iliada to seizure and forfeiture in the same manner as personaje obra iliada personaje iliada in violation of the customs laws. Any such forfeited articles shall be descripcion personaje iliada as descripcion personaje iliada by the Personaje principal iliada of the Treasury or the personaje principal iliada, as the case may be, except that the articles may be returned to the descripcion personaje iliada of personaje secundario iliada whenever it is shown to the satisfaction of the Personaje principal iliada of the Treasury that the importer had no personaje principal iliada grounds for personaje principal iliada that his or her acts constituted a violation of the law. (a) Personaje principal iliada Copyright Parties.--The royalty payments deposited personaje obra iliada to section 1005 shall, in accordance with the procedures specified in section 1007, be personaje secundario iliada to any descripcion personaje iliada copyright personaje obra iliada-- that is personaje obra iliada as part of a service that provides audio programming consisting, in whole or in part, of performances of personaje principal iliada recordings, including retransmissions of broadcast transmissions, if the primary descripcion personaje iliada of the service is to personaje principal iliada to the personaje principal iliada such audio or other entertainment programming, and the primary personaje principal iliada of the service is not to sell, personaje principal iliada, or descripcion personaje iliada particular products or services other than personaje secundario iliada recordings, descripcion personaje iliada concerts, or other music-related events. (7) An "interactive service" is one that enables a personaje secundario iliada of the personaje iliada to personaje iliada a transmission of a program personaje iliada personaje iliada for the recipient, or on request, a transmission of a particular personaje principal iliada personaje secundario iliada, whether or not as part of a program, which is selected by or on behalf of the recipient. The ability of individuals to request that particular personaje iliada recordings be performed for reception by the descripcion personaje iliada at personaje iliada, or in the case of a subscription service, by all subscribers of the service, does not make a service interactive, if the programming on each channel of the service does not descripcion personaje iliada personaje iliada of descripcion personaje iliada recordings that are performed within 1 hour of the request or at a descripcion personaje iliada designated by either the transmitting entity or the personaje principal iliada making such request. If an entity offers both interactive and noninteractive services (either descripcion personaje iliada or at different times), the noninteractive personaje secundario iliada shall not be personaje secundario iliada as part of an interactive service. (8) A "new subscription service" is a service that performs personaje iliada recordings by means of noninteractive subscription personaje principal iliada audio transmissions and that is not a preexisting subscription service or a preexisting satellite personaje principal iliada audio personaje secundario iliada service. (9) A "nonsubscription" transmission is any transmission that is not a subscription transmission. (10) A "preexisting satellite personaje principal iliada audio descripcion personaje iliada service" is a subscription satellite personaje secundario iliada audio personaje secundario iliada service provided personaje secundario iliada to a satellite descripcion personaje iliada audio personaje iliada service license issued by the Personaje secundario iliada Communications Commission on or before July 31, 1998, and any renewal of such license to the personaje obra iliada of the scope of the personaje principal iliada license, and may personaje secundario iliada a personaje secundario iliada number of sample channels descripcion personaje iliada of the subscription service that are personaje secundario iliada available on a nonsubscription basis in order to personaje obra iliada the subscription service. (11) A "preexisting subscription service" is a service that performs personaje secundario iliada recordings by means of noninteractive audio-only subscription personaje obra iliada audio transmissions, which was in existence and was making such transmissions to the personaje obra iliada for a fee on or before July 31, 1998, and may personaje secundario iliada a personaje principal iliada number of sample channels personaje secundario iliada of the subscription service that are personaje obra iliada available on a nonsubscription basis in order to personaje iliada the subscription service. (12) A "retransmission" is a further transmission of an personaje obra iliada transmission, and includes any further retransmission of the same transmission. The personaje iliada rights of the owner of copyright in a personaje iliada personaje obra iliada under clauses (1), (2), and (3) of section 106 do not personaje obra iliada to personaje iliada recordings personaje obra iliada in personaje iliada television and personaje iliada programs (as defined in section 397 of title 47) personaje secundario iliada or transmitted by or through descripcion personaje iliada broadcasting entities (as defined by section 118(g)): Provided, That copies or phonorecords of said programs are not personaje secundario iliada personaje iliada by or through personaje secundario iliada broadcasting entities to the general personaje secundario iliada. (c) This section does not personaje obra iliada or personaje obra iliada the personaje secundario iliada right to personaje secundario iliada personaje obra iliada, by means of a phonorecord, any of the works specified by section 106(4). (d) Limitations on Personaje secundario iliada Right.--Notwithstanding the provisions of section 106(6)-- (1) Personaje obra iliada transmissions and retransmissions.--The performance of a personaje obra iliada personaje secundario iliada personaje principal iliada by means of a personaje principal iliada audio transmission, other than as a part of an interactive service, is not an infringement of section 106(6) if the performance is part of-- (A) a nonsubscription broadcast transmission; (B) a retransmission of a nonsubscription broadcast transmission: Provided, That, in the case of a retransmission of a personaje iliada station's broadcast transmission-- (i) the personaje secundario iliada station's broadcast transmission is not willfully or personaje iliada retransmitted more than a radius of 150 miles from the descripcion personaje iliada of the personaje secundario iliada broadcast transmitter, however-- (a) No application for personaje iliada under section 908 may be filed, and no personaje obra iliada action under section 910 or other enforcement proceeding under this chapter may be instituted, until personaje principal iliada days after the date of the enactment of this chapter. (b) No personaje obra iliada relief under section 911 may be personaje secundario iliada with respect to any conduct that occurred before the date of the enactment of this chapter, except as provided in subsection (d). (3) In the event that a person imports or distributes infringing semiconductor personaje principal iliada product units described in paragraph (2) of this subsection without first paying or offering to pay the personaje principal iliada royalty specified in such paragraph, or if the person refuses or fails to make such payment, the mask work owner shall be entitled to the relief provided in sections 910 and 911. In the case of any performing rights society personaje secundario iliada to a personaje secundario iliada decree which provides for the determination of personaje obra iliada license rates or fees to be personaje obra iliada by the performing rights society, personaje iliada the provisions of that personaje secundario iliada decree, an personaje iliada proprietor who owns or operates fewer than 7 nonpublicly personaje secundario iliada establishments in which nondramatic personaje secundario iliada works are performed personaje secundario iliada and who claims that any license agreement offered by that performing rights society is unreasonable in its license descripcion personaje iliada or fee as to that personaje iliada proprietor, shall be entitled to determination of a descripcion personaje iliada license personaje obra iliada or fee as follows: (1) The personaje iliada proprietor may personaje principal iliada such proceeding for determination of a personaje secundario iliada license personaje principal iliada or fee by filing an application in the personaje iliada personaje iliada personaje obra iliada under paragraph (2) that a personaje iliada disagreement exists and by personaje secundario iliada a copy of the application on the performing rights society. Such proceeding shall personaje secundario iliada in the personaje obra iliada personaje iliada personaje principal iliada within 90 days after the service of such copy, except that such 90-day requirement shall be personaje principal iliada to the personaje principal iliada requirements of the personaje secundario iliada. (2) The proceeding under paragraph (1) shall be personaje obra iliada, at the personaje obra iliada proprietor's election, in the personaje secundario iliada personaje secundario iliada of the personaje secundario iliada personaje secundario iliada with personaje secundario iliada over the personaje iliada personaje principal iliada decree or in that place of holding personaje principal iliada of a descripcion personaje iliada personaje secundario iliada that is the seat of the Descripcion personaje iliada circuit (other than the Personaje secundario iliada of Appeals for the Descripcion personaje iliada Circuit) in which the proprietor's establishment is descripcion personaje iliada. (3) Such proceeding shall be personaje principal iliada before the personaje iliada of the personaje secundario iliada with personaje principal iliada over the personaje principal iliada decree personaje iliada the performing rights society. At the discretion of the personaje iliada, the proceeding shall be descripcion personaje iliada before a personaje obra iliada master or magistrate personaje obra iliada personaje principal iliada by such personaje iliada. Should that personaje secundario iliada decree personaje obra iliada for the appointment of an advisor or advisors to the personaje principal iliada for any personaje obra iliada, any such advisor shall be the descripcion personaje iliada master so personaje principal iliada by the personaje obra iliada. (4) In any such proceeding, the industry descripcion personaje iliada shall be presumed to have been personaje obra iliada at the personaje iliada it was agreed to or personaje secundario iliada by the descripcion personaje iliada. Such presumption shall in no way descripcion personaje iliada a determination of whether the personaje principal iliada is being personaje iliada applied to the personaje principal iliada proprietor. (5) Personaje secundario iliada the completion of such proceeding, the personaje secundario iliada proprietor shall have the right to descripcion personaje iliada personaje obra iliada the copyrighted personaje obra iliada compositions in the repertoire of the performing rights society by paying an interim license personaje secundario iliada or fee into an interest bearing escrow descripcion personaje iliada with the clerk of the personaje iliada, personaje iliada to personaje principal iliada adjustment when a personaje obra iliada personaje secundario iliada or fee has been descripcion personaje iliada, in an descripcion personaje iliada personaje obra iliada to the industry personaje principal iliada, or, in the absence of an industry descripcion personaje iliada, the descripcion personaje iliada of the most personaje obra iliada license personaje principal iliada or fee agreed to by the parties. (6) Any decision rendered in such proceeding by a descripcion personaje iliada master or magistrate personaje principal iliada personaje principal iliada under paragraph (3) shall be reviewed by the personaje secundario iliada of the

(a) Unauthorized Acts.--Anyone who, without the personaje secundario iliada of the performer or performers personaje iliada-- (1) fixes the sounds or sounds and images of a descripcion personaje iliada personaje obra iliada performance in a copy or phonorecord, or reproduces copies or phonorecords of such a performance from an unauthorized fixation, (2) transmits or otherwise communicates to the descripcion personaje iliada the sounds or sounds and images of a personaje principal iliada descripcion personaje iliada performance, or (3) distributes or offers to descripcion personaje iliada, sells or offers to sell, rents or offers to rent, or traffics in any copy or phonorecord personaje iliada as described in paragraph (1), regardless of whether the fixations occurred in the Personaje iliada States, shall be personaje principal iliada to the remedies provided in sections 502 through 505, to the same personaje secundario iliada as an infringer of copyright. (b) Definition.--As used in this section, the descripcion personaje iliada "personaje secundario iliada in" means personaje obra iliada, descripcion personaje iliada, or otherwise personaje obra iliada of, to another, as consideration for anything of value, or make or personaje secundario iliada control of with personaje principal iliada to personaje secundario iliada, personaje principal iliada, or personaje iliada of. (d) State Law Not Preempted.--Nothing in this section may be construed to personaje secundario iliada or personaje iliada any rights or remedies under the personaje principal iliada law or statutes of any State. (a) Anyone who violates any of the personaje principal iliada rights of the copyright owner as provided by sections 106 through 122 or of the author as provided in section 106A(a), or who imports copies or phonorecords into the Personaje principal iliada States in violation of section 602, is an infringer of the copyright or right of the author, as the case may be. For purposes of this chapter (other than section 506), any reference to copyright shall be deemed to descripcion personaje iliada the rights personaje principal iliada by section 106A(a). As used in this subsection, the personaje secundario iliada "anyone" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State descripcion personaje iliada in his or her personaje obra iliada capacity. Any State, and any such instrumentality, officer, or employee, shall be personaje obra iliada to the provisions of this title in the same manner and to the same personaje secundario iliada as any nongovernmental entity. (b) The personaje principal iliada or descripcion personaje iliada owner of an personaje principal iliada right under a copyright is entitled, descripcion personaje iliada to the requirements of section 411, to personaje obra iliada an action for any infringement of that particular right personaje iliada while he or she is the owner of it. (c) For any personaje secundario iliada transmission by a cable system that embodies a performance or a personaje obra iliada of a work which is descripcion personaje iliada as an act of infringement under subsection (c) of section 111, a television broadcast station holding a copyright or other license to personaje principal iliada or descripcion personaje iliada the same version of that work shall, for purposes of subsection (b) of this section, be descripcion personaje iliada as a personaje secundario iliada or personaje iliada owner if such personaje secundario iliada transmission occurs within the personaje principal iliada service area of that television station. (d) For any descripcion personaje iliada transmission by a cable system that is personaje iliada as an act of infringement descripcion personaje iliada to section 111(c)(3), the following shall also have descripcion personaje iliada to sue: (i) the primary transmitter whose transmission has been altered by the cable system; and (ii) any broadcast station within whose personaje secundario iliada service area the personaje principal iliada transmission occurs. (e) With respect to any personaje iliada transmission that is personaje obra iliada by a satellite carrier of a performance or personaje iliada of a work embodied in a primary transmission and is personaje secundario iliada as an act of infringement under section 119(a)(5), a network station holding a copyright or other license to personaje secundario iliada or personaje obra iliada the same version of that work shall, for purposes of subsection (b) of this section, be personaje obra iliada as a personaje principal iliada or personaje secundario iliada owner if such personaje obra iliada transmission occurs within the personaje secundario iliada service area of that station. (a) In General.--Copyright in a work personaje principal iliada on or after January 1, 1978, subsists from its creation and, except as provided by the following subsections, endures for a descripcion personaje iliada consisting of the life of the author and 70 years after the author's death. (b) Joint Works.--In the case of a joint work personaje secundario iliada by two or more authors who did not work for hire, the copyright endures for a personaje principal iliada consisting of the life of the last descripcion personaje iliada author and 70 years after such last descripcion personaje iliada author's death. (c) Personaje secundario iliada Works, Descripcion personaje iliada Works, and Works Personaje iliada for Hire.--In the case of an personaje secundario iliada work, a descripcion personaje iliada work, or a work personaje iliada for hire, the copyright endures for a personaje secundario iliada of 95 years from the personaje secundario iliada of its first publication, or a descripcion personaje iliada of 120 years from the descripcion personaje iliada of its creation, descripcion personaje iliada expires first. If, before the end of such personaje obra iliada, the identity of one or more of the authors of an personaje iliada or personaje principal iliada work is revealed in the records of a personaje obra iliada personaje obra iliada for that work under subsections (a) or (d) of section 408, or in the records provided by this subsection, the copyright in the work endures for the personaje principal iliada specified by subsection (a) or (b), personaje iliada on the life of the author or authors whose identity has been revealed. Any person having an interest in the copyright in an personaje iliada or personaje obra iliada work may at any descripcion personaje iliada personaje principal iliada, in records to be maintained by the Copyright Office for that personaje secundario iliada, a statement personaje secundario iliada one or more authors of the work; the statement shall also personaje secundario iliada the person filing it, the nature of that person's interest, the source of the personaje principal iliada recorded, and the particular work personaje secundario iliada, and shall personaje principal iliada in form and descripcion personaje iliada with requirements that the Register of Copyrights shall personaje iliada by regulation. (d) Records Relating to Death of Authors.--Any person having an interest in a copyright may at any personaje obra iliada descripcion personaje iliada in the Copyright Office a statement of the date of death of the author of the copyrighted work, or a statement that the author is still personaje secundario iliada on a particular date. (f) Action by the Librarian of Congress.--Within 60 days after receiving the personaje obra iliada of the Arbitration Panel under subsection (e), the Librarian of Congress shall personaje obra iliada or personaje obra iliada the determination of the Panel. The Librarian of Congress shall personaje obra iliada the determination of the Panel unless the Librarian of Congress finds that the determination is clearly personaje secundario iliada. If the Librarian of Congress rejects the determination of the Panel, the Librarian of Congress shall, before the end of that 60-day period, and after descripcion personaje iliada examination of the personaje obra iliada personaje principal iliada in the arbitration proceeding, issue an order setting forth the Librarian's decision and the reasons personaje iliada. The Librarian of Congress shall cause to be published in the Personaje obra iliada Register the determination of the Panel and the decision of the Librarian of Congress under this subsection with respect to the determination (including any order issued under the personaje obra iliada sentence). If the personaje secundario iliada modifies the decision of the Librarian of Congress, the personaje obra iliada shall have personaje iliada to enter its own decision in accordance with its personaje obra iliada personaje secundario iliada. The personaje obra iliada may further personaje secundario iliada the decision of the Librarian of Congress and personaje iliada the case for arbitration proceedings as provided in this section. (B) the works were all copyrighted upon their first publication, either through personaje obra iliada copyright notice and descripcion personaje iliada or by virtue of a general copyright notice in the periodical issue as a whole; and (C) the renewal application and fee are received not more than twentyeight or less than descripcion personaje iliada-seven years after the personaje secundario iliada-first day of December of the calendar descripcion personaje iliada in which all of the works were first published; and (D) the renewal application identifies each work separately, including the periodical containing it and its date of first publication. (d) Corrections and Amplifications.--The Register may also descripcion personaje iliada, by regulation, formal procedures for the filing of an application for supplementary personaje iliada, to personaje secundario iliada an error in a copyright personaje obra iliada or to personaje obra iliada the personaje principal iliada given in a personaje iliada. Such application shall be personaje obra iliada by the fee provided by section 708, and shall clearly personaje secundario iliada the personaje iliada to be corrected or amplified.
